Dear Investor,
Reference to the above mentioned subject and the regulations set by the Capital Market Authority (CMA) regarding the disclosure of material information and our disclosure dated February 16th, 2016 with respect to the Qui Tam Proceedings in an order dated February 5, 2016, where we disclosed that the United States District Court granted the United States' motion for alternative service of the Parent Company. The Qui Tam Proceedings are pending in the Northern District of Georgia in the United States and the order is not a final judgment in the matter.
Agility would like to inform you, that additionally, in the Qui Tam Proceedings pending in the Northern District of Georgia, in an order dated May 12, 2016, the United States District Court granted the relator's motion for alternative service of the Parent Company. Such order is, likewise, not a final judgment in the matter.
Note that, and as we have already disclosed, the Kuwaiti Courts have issued final judgement in favor of the company for the impermissibility of serving the company through judicial means.
