ARISTOCRAT STATEMENT ON KATER LITIGATION

Aristocrat Leisure Limited (ASX: ALL) notes comments in a filing made by Churchill Downs Incorporated (CDI) referring to the case of Kater v Churchill Downs Incorporated (CDI).

This litigation relates to the operation of the online social gaming platform Big Fish Casino, which is part of Big Fish Games, Inc. Aristocrat completed its acquisition of Big Fish Games, Inc from CDI in January 2018.

Aristocrat and CDI are working together to vigorously defend the action.

Aristocrat agrees with CDI's statement "that there are meritorious legal and factual defences against (the) Plaintiff's allegations and requests for relief" and Aristocrat is not

aware of any other US Court having expressed an opinion similar to that of the court in this action.

Aristocrat confirms that the Kater litigation was known and fully considered as part of the due diligence exercise it conducted in connection with the Big Fish acquisition. A number of contractual protections were agreed as part of the acquisition, including broad indemnity protection from CDI relating specifically to the Kater litigation.
