This story started out normal enough, a tradesman blows the whistle on fraud, law suit filed, 1.4 billion dollar wall st company starves him out or they settle right? Well in this case things are taking a much more interesting path. Kristian pedersen joined a federal class action against Chemed corporation because they were forcing him to work unrecorded hours, not paying overtime, taking illegal deductions out of his paycheck and often not even paying him minimum wage while he worked as a licensed Plumber. 6 months later Kristian Blew the whistle on consumer fraud (The company was using unlicensed people posing as plumbers against state law) in Massachusetts and was terminated 2 weeks later. Kristian filed a suit in Massachusetts and a complaint with the state whichthey are now prosecuting. Heres where things get impressive to me. Kristian was informed that Chemed's 2 major holdings were roto rooter(his former employer) and Vitas healthcare. Vitas was in deep trouble in an investigation into medicare fraud for admitting non terminal patients to thier for profit hospice company. This launched an investigation into securities fraud at Chemed in which the CEO and CFO are both now deffendents. Now during this time of turmoil at Chemed Rotorooter got hit with another class action in MN in which claimed they were committing consumer fraud by doing un-needed sewer line excavations in a scam to increase profits by sending Techs to video inspect sewer lines and then require them to dif it up and replace it at the cost of thousands. This policy..as members of the class action for fair labor have said is a National policy as well. This inspired Kristian to start asking about the Licensed Plumbers in other states. That's when Kristian dug further to find that other states have had the same problem. CT had to arrest 3 Roto rooter employees for fraud in 2009 and recently a Roto rooter tech in Minnesota filed a NLRB complaint because he alleges Roto rooter terminated him for refusing to do work he was not licensed to do...or was fired for refusing to break state laws. Kristian immediately contacted them and the authorities in MN. He realized it was a criminal conspiracy to fraud consumers throughout the U.S.
Now heres where things get better..after researching he found out that David Willaims CFO and Kevin Mcnamara who I remind you are both defendents in a securities fraud suit were hefty contributers to House speaker John Boehner Super PAC "Friends of John Boehner. Now a Politician as well know as John who is a champion for the small businessman and advocate for health care reform certainly cant be recieving donations from a company that's being investigated for frauding the government can he? apparently he doesn't think its a problem... His problem now isn't Chemed its Kristian as he Puts this story to the people to decide...He has exposed this 1.4 billion dollar Wall st company for as he calls it "Playground economics" As Kristian says Chemed is a 1.4 billion dollar company with a business model based on "your guess is as good as mine" They've taken 2 companies that were supposed to serve communities and now they serve themselves. Theyve put Profits above public safety and don't really offer a "Service" anymore. My firm belief is that Wall st is an imaginary place where rich people go to pretend to work.. There's no regulations, guidlines, rules they don't break...Its a free for all and that's why I call it playground economics. Joel F germunder who sits on the Board of directors at Chemed is the retired CEO of Omnicare who recently settled a medicare fraud suit and reimbursed the federal government $50 million . Joel was also a contributer to the 2000 election campaign of our formner President Bush who opposed Healthcare reform.
Kristian has put all of the Peices together,Granted he is a Plumber not a publicist but he is getting the story out to people in a form that connects with the average citizen. Thanks
