(S)-Lactic acid approved for use as an active substance in biocidal products under the BPR (EU)

The European Commission has approved (S)-lactic acid for use as active substance in biocidal products in product types 2, 3, and 4 under the EU's Biocidal Products Regulation (BPR). The published approval date is 1 May 2019. To comply with this important regulation, Corbion's customers will need to submit an application for specific authorization for any of their biocidal products containing (S)-lactic acid (previously called L(+) lactic acid), by 1 May 2019.

If the product is already marketed according to national regulations in the transitional period and fulfills the description above (existing products PT2, 3 or 4), the dossier must be submitted by 1 May 2019, or before. Otherwise, the product must be removed from the market after the approval date (phase-out period). If the product is not yet marketed (new products PT2, 3 or 4), the dossier can be submitted after 1 May 2019. In this case, however, the biocidal product can only be marketed after authorization has been granted.

The product types are:

· PT2 - disinfectants and algaecides not intended for direct application
to humans or animals.

· PT3 - veterinary hygiene.

· PT4 - food and feed areas.

Approval is subject to compliance with certain specifications and conditions.

In 2007, Corbion (via its legal entity, Purac Biochem bv) submitted an application for review of (S)-lactic acid as active substance in biocidal products in PT's 2, 3 and 4. This evaluation was carried out in the context of the work program for the review of existing active substances provided for in Article 89 of the BPR (No 528/2012). Germany was designated as Rapporteur Member State to carry out the assessment on basis of the dossiers submitted by Corbion. On 3 May 2016, Germany submitted an assessment report and the conclusions of its evaluation to the ECHA (European Chemicals Agency). The ECHA BPC's Final (positive) Opinion was published on 27 April 2017.
