On 21 September 2017, the Central Bankruptcy Court has given order for legal black case no. phor.27/2560 with respect to Energy Earth Public Company Limited ("Debtor"). The Court has ordered the Debtor to enter into the rehabilitation process and appointed EY Corporate Advisory Services Co., Ltd. as the Planner.

By Law, EY Corporate Advisory Services Co., Ltd., as the Planner, will have to create the rehabilitation plan within 3 months from the publication date of the court order in the Royal Thai Government Gazette. The Court may grant extension twice with one month period each time. However, for this case, the Court has requested EY Corporate Advisory Services Co., Ltd. to create the rehabilitation plan within 2 months, which EY Corporate Advisory Services Co., Ltd. has accepted and will submit the Plan to the Official Receiver of Legal Execution Department within the agreed time frame.

For the contingent liabilities of THB 26,000 million, the Company has estimated the liabilities from legal action by various partners for damage claims since the Company facing liquidity problem. The Company has requested the Central Bankruptcy Court to call for the court mediation among those partners and the Company will invite them to negotiate in court accordingly.
