Dear Madam or Sir

Notice of Appeal by Fortescue Metals Group Ltd, The Pilbara Infrastructure Pty Ltd and FMG Pilbara Pty Ltd from the judgment in Warrie (Formerly TJ) (on behalf of the Yindjibarndi People) v State of Western Australia

Fortescue Metals Group Ltd, The Pilbara Infrastructure Pty Ltd and FMG Pilbara Pty Ltd (Fortescue) have lodged their Notice of Appeal from the above judgment.

Fortescue has previously advised that the Court's decision has no impact on the current and future operations or mining tenure at the Solomon Hub and the Company does not anticipate any material financial impact to the business following the Court's determination.

Fortescue Chief Executive Officer, Mr Nev Power said, "Through our seven Land Access Agreements with native title groups across the Pilbara, we have delivered employment to over 1200 Aboriginal people and nearly $2 billion in contracts to Aboriginal businesses in addition to compensation payments."

"Consistent with our position during the trial, Fortescue welcomes the recognition of Yindjibarndi native title. However, the Federal Court decision relating to the concept of exclusive possession has potentially wide ranging implications for new investment in resources, agriculture and tourism", Mr Power said.

Fortescue will continue its approach of providing training, employment and business development opportunities for Aboriginal people to ensure that communities benefit from the growth and development of Fortescue.

Yours sincerely

Fortescue Metals Group Ltd Alison Terry
