Injection Permit for the Werra Potash Plant

Gerstungen Municipality has suffered a further defeat before the Kassel Administrative Court in the dispute over the injection permit currently in force.

The municipality had already sought an interim injunction back in 2012 opposing the temporary permit to inject saline wastewater into plate dolomite, which was granted under water law and runs until the end of November 2015. The aim was to prevent the immediate implementation of the permit granted to K+S KALI GmbH in November 2011. The municipality failed in this before the Kassel Administrative Court in the first instance as well as in a subsequent appeal lodged with the Hesse Administrative Court. An appeal then filed by the municipality citing constitutional grounds was dismissed by the Federal Constitutional Court.

With its latest action, the municipality sought to demonstrate that new information had emerged that could not have been considered in the original proceedings.

However, this was not accepted by the court, which dismissed the action. Gerstungen municipality was ordered to cover the costs of the proceedings.
