IDGC of Centre familiarized itself with the Decision and the Instruction of the Office of the Federal Antimonopoly Service for the Voronezh region on the results of consideration of the complaint against the actions of the tender organizers during the tender for the right to purchase the property of MUE Voronezhskaya Gorelektroset (MUE VGES).

The decision reasonably denied the argument of the organizer of the tender - MUE VGES, that the tender for selling the property of the municipal enterprise is not stipulated by the law and is not subject to verification by the antimonopoly body. The commission identified in the actions of MUE 'Voronezhskaya Gorelectroset' signs of abuse during the tender and pointed out violation of the rights of IDGC of Centre.

The Antimonopoly Service found that JSC 'GES' and JSC 'EnergoInvest' for evaluation of applications under the sub-criterion 'Personnel Qualification' did not confirm the necessary vocational education of employees, and IDGC of Centre included in the package of documents for participation in the tender copies of diplomas and certificates of qualification improvement of its employees. However, the tender commission awarded equal assessments to all participants, which violated the requirements of its own documentation. This violation is reflected in the Decision, and MUE 'VGES' is ordered to reassess the applications for the specified sub-criteria, taking into account the documents actually submitted by the tender participants.

The abuse of MUE 'VGES', admitted during the evaluation of Technical Policies, is given special attention in the Commission's Decision. The Commission indicated that the assessment in this case was conducted 'subjectively for each criterion, since the methodology for applying the point system for each criterion, as well as the formula for counting votes collected as a result of the evaluation of applications, were absent in the tender documentation'. As a result, the decision found a violation by MUE 'VGES' of the competition conditions established by law.

The antimonopoly authority made the decision based on the grounded arguments of IDGC of Centre. Thus, it helps maintain the company's legitimate rights to an impartial and fair bidding process. In turn, the organization will continue to closely monitor and by all legal means suppress any attempted violations during the repeated procedure of summarizing the tender. Abuse by the organizers or unscrupulous participants will be immediately informed to the oversight agencies.
