The EU has recently added 12 SVHCs to the Authorization List in Annex XIV of REACH. There are no exemptions to the use of these newly added substances.

In October 2016, we [1] informed you that the World Trade Organization (WTO) had circulated a notification from the European Union (EU) announcing its intention to add 12 substances of very high concern (SVHCs) to the Authorization List under Annex XIV of REACH.

SVHCs on the Authorization List (Annex XIV) are drawn from the Candidate List. In order to use an SVHC from this list, an authorization for specific uses must be obtained from the European Commission (EC).

On June 14, 2017, the EU published Regulation (EU) 2017/999 [2] to expand the list of SVHCs on the Authorization List from 31 to 43. This publication was the fifth amendment to the Authorization List and was complemented by a press release (ECHA/NI/17/21 [3]) from the European Chemicals Agency (ECHA) announcing the inclusion of 12 SVHCs from the ECHA's fifth and sixth Annex XIV recommendations of February 2014 and July 2015, respectively.

According to the new amendment, there are no exemptions for specific uses for each of these 12 new SVHCs. It is interesting to note that this amendment contains seven phthalates (entries 33 to 39, Table 1).

Anthracene oil (entry 40, Table 1) is classified as persistent, bioacumulative and toxic (PBT), very persistent and very bioacumulative (vPvB). It would also be classified as carcinogenic category 1B if it contains benzo[a]pyrene in a concentration of equal or greater than 0.005%.

There are three sets of dates for 'latest application' and 'sunset' dates. These are:

Entries 32 to 39 (Table 1)

  • January 4, 2019 latest application date
  • July 4, 2020 sunset date

Entries 40-41 (Table 1)

  • April 4, 2019 latest application date
  • October 4, 2020 sunset date

Entries 42 and 43 (Table 1)

  • July 4, 2019 latest application date
  • January 4, 2021 sunset date
