Singapore has implemented measures to expand its list of controlled hazardous substances under the Environmental Protection and Management Act. The new amendments will become effective on June 30, 2018.

In November 2017, the World Trade Organization (WTO) circulated an amended notification [1] from Singapore announcing its intention to regulate short-chain chlorinated paraffins (SCCP), polychlorinated naphthalenes (PCN) and trichlorfon as hazardous substances under the Environmental Protection and Management Act (EPMA) and EPM (Hazardous Substances) Regulations

In December 2017, Singapore published two revisions to amend the EPMA (Chapter 94A) [2] by expanding the list of regulated hazardous substances. These amendments are:

  • S 782/2017 [3] - 'Environmental Protection and Management (Hazardous Substances) (Amendment) Regulations 2017

  • S 783/2017 [4] - 'Environmental Protection and Management Act (Amendment of Second Schedule) (No. 3) Order 2017

According to S 782/2017, PCN and SCCP are added to the list of hazardous substances in the Schedule of the EPM (Hazardous Substances) Regulations (Rg 4) [5]. Hazardous substances in this Schedule require a license and permit [6] if they are imported, stored, sold or exported.

The amendments in S 783/2017 are related to Part 1 of the Second Schedule to the EPMA relating to 'Control of Hazardous Substances' and Part II of Second Schedule to the EPMA relating to 'General Exemptions'.

The important changes to Part 1 of the Second Schedule to the EPMA include the following:

  • Trichlorfon is now regulated as one of the controlled hazardous substances under 'Phosphorus compounds used as pesticides'

  • Inclusion of PCN and SCCP but with no specific exemption for each substance

The amendment to Part II of Second Schedule to the EPMA prohibits PCN or SCCP in adhesives, lubricants, paints and plastics as part of the general prohibition.

S 783/207 has in effect placed a general prohibition of PCN or SCCP if these are used as constituents of substances, in mixtures or products.

These amendments will become effective on June 30, 2018.
