SAFEGUARDS | Hardgoods NO. 013/17

On November 25, 2016 Canada published SOR/2016-302 [1] which amended the Toys Regulations (SOR/2011-17) [2]. The amendments are primarily updates and administrative changes that do not change the obligations placed on manufacturers significantly.

The amendments include:

  • Addition a definition of 'Good Scientific practices' and 'Human Experience Data'. These definitions are used in the updated Schedule 2 and 3.
  • Editorial changes have been made to section 7 Small Parts. The requirements are the same.
  • Sections 26 and 27 were simplified and clarified. The reference to the Phthalates Regulations (SOR/2016-188) was removed; however, the Phthalates Regulations are still in force and still apply to toys. References to use of Food Grade plastics were removed.
  • Section 43 and Schedule 9 that set requirements for batteries used in toys were removed completely. The requirements were intended to address battery construction that is no longer commonly used.
  • Schedule 2 and 3 are amended with several revisions related to determining if products are toxic.
