The US CPSC published a direct final rule mandating ASTM F963-16 for toys. The new standard will become effective on April 30, 2017.

In August 2008, President George W. Bush signed the Consumer Product Safety Improvement Act of 2008 (CPSIA [1]) into law. This landmark legislation mandated [2] that in February 2009, ASTM F963-07 was to become a mandatory consumer product safety standard.

Since February 2009, there have been two revisions to ASTM F963-07: ASTM F963-08 and ASTM F963-11. At present, provisions in section 4.27 of ASTM F963-07 on toy chests and ASTM F963-11 are also considered mandatory consumer product safety standards issued by the Consumer Product Safety Commission (CPSC).

In October 2016, the American Society for Testing and Materials (ASTM) published ASTM F963-16. This new standard contains substantial changes to the 2008 version, including requirements for toy chests, new requirements to increase safety and to address new types of toys and hazards. It is now more aligned to mechanical and physical properties in EN 71-1 and ISO 8124-1. Further information on the changes can be found in SGS Safeguards 168/16 [3].

On November 1, 2016, ASTM notified the CPSC that they had published ASTM F963-2016. Once the CPSC is notified, unless an update is rejected by the CPSC within 90 days, the standard becomes effective 180 days after the date on which ASTM petitions the Commission.

On February 2, 2017, the CPSC published the direct final rule [4] in the Federal Register to mandate ASTM F963-2016 as a consumer product safety standard for toys. Unless significant adverse comments are received by March 6, 2017, this rule will become effective on April 30, 2017.

To allow test laboratories sufficient time to update their scope of accreditation to include ASTM F963-16 and be CPSC-accepted, the CPSC will accept ASTM F963-2016 testing results by test laboratories that are CPSC-accepted to ASTM F963-11 sections for a period of not more than two years.
