VISION EYE INSTITUTE LIMITED (ASX: VEI) JUDGEMENT AND ORDERS RECEIVED FROM THE SUPREME COURT OF QUEENSLAND

On 21 September 2009, Vision Eye Institute Limited (VEI) commenced action in the Supreme Court of Queensland against Dr David Kitchen and others in connection with what VEI contended was Dr Kitchen's wrongful termination of his service agreement with Icon Laser Australia Pty Limited (a subsidiary of VEI). Dr Kitchen made a counterclaim against VEI in respect of this matter.
The trial was held in June 2014 in the Queensland Supreme Court and on 24 October 2014, the Honourable
Justice Applegarth published reasons in favour of VEI in relation to its breach of contract claim, with
Dr Kitchen's counterclaim dismissed.
Yesterday, following a process of submissions by the parties on the calculation of damages, the Honourable Justice Applegarth delivered judgment ordering Dr Kitchen to pay VEI damages and interest in the amount of $10,845,476. The orders were formally pronounced at 4.45pm yesterday.
The parties now have the opportunity to make submissions on the question of costs. Dr Kitchen has 28 days from the date of the orders in which to lodge an appeal.
