CEB : Receives Six-Figure Settlement in Federal Lawsuit to Protect Its Proprietary Challenger™ Intellectual Property

ARLINGTON, Va., May 4, 2016-CEB (NYSE:CEB), a best practice insight and technology company, announced today that it has obtained a high six-figure settlement in a federal lawsuit CEB brought against a training services provider for trademark infringement, false advertising, and unfair competition related to CEB's Challenger™ services.

In its claim, CEB objected to the provider's use of CEB's Challenger brand in connection with the creation and provision of consulting materials, consulting services, and training. Without authorization or approval from CEB, the provider offered to develop commercial insight messaging materials for its customers in an attempt to help those customers implement the Challenger sales methodology.

'CEB has expended a substantial amount of money and effort in developing and expanding the Challenger brand, including investment in new research and in a world-wide trademark portfolio' said CEB Group Leader, Nathan Blain. 'CEB aggressively protects its intellectual property rights and is pleased to have successfully resolved this dispute in our favor.'

In the settlement, the provider admitted infringement and CEB received a high six-figure payment. The provider agreed the Challenger trademarks may not be used by parties other than CEB to describe modern sales techniques, disruptive sales techniques, confrontational selling, insight selling techniques, or the like, and that CEB's Challenger branded literature are copyrighted works that cannot be used by third parties to create derivative works. The provider is prohibited from using the Challenger brand for commercial purposes of any kind, including promotion or advertising for their services. The provider agreed to remove from circulation and destroy all materials mentioning the Challenger brand and is required to notify any inbound prospect for Challenger services of CEB's intellectual property rights.
