Demandware® Inc. (NYSE: DWRE) the industry-leading provider of enterprise cloud commerce solutions, today announced that the patent lawsuit filed by Shipping & Transit (formerly known as ArrivalStar and Melvino Technologies) has been resolved.

In the settlement, the parties agreed that Shipping & Transit will never file any lawsuit against Demandware, nor make any claim that any Demandware product or service infringes any Shipping & Transit patent. Demandware also agreed to dismiss its countersuit against Shipping & Transit. No payment was made by Demandware to Shipping & Transit as part of the settlement, nor did Shipping & Transit make any payment to Demandware. The parties agreed to a “walk-away” settlement after Demandware demonstrated no infringement of the patents-in-suit.

Tom Ebling, Demandware CEO stated, “Our cloud commerce platform did not violate the Shipping & Transit patents, but Shipping & Transit and other patent trolls have built businesses filing baseless patent infringement claims. We decided to take an aggressive stance and I am thrilled with the outcome, which I view as a victory over patent trolls.”
