On May 19, 2017 U.S Consumer Product Safety Commission (CPSC) unanimously voted and proposed a notice of rulemaking (NPR) to establish a safety standard for Booster Seats [1] to include in the list of notice of requirements (NORs) issued by the Commission. The notice of proposed rulemaking is in response to the direction under section 104(b) of the CPSIA to amend 16 CFR Part 1112 to include 16 CFR 1237 and promulgate consumer product safety standards for durable infant or toddler products.

The proposed rule would incorporate by reference the most recent booster seat voluntary standard developed by ASTM F2640-17 to be 'substantially the same as' applicable Standard Consumer Safety Specification for Booster Seats, without modification.

Definition of 'Booster Seat'

ASTM F2640-17 1 defines a 'booster seat' as 'a juvenile chair, which is placed on an adult chair to elevate a child to standard dining table height'. The booster seat is made for the purpose of containing a child, up to 5 years of age, and normally for the purposes of feeding or eating. Booster seats may be constructed from a wide variety of materials, including wood, plastic, fabric, metal, and/or foam. The ASTM standard covers combination products when they are in their booster seat configuration. However, the standard does not cover car booster seats, which are also sometimes referred to as 'booster seats'.
