The World Trade Organization (WTO) has circulated a notification from the European Union announcing its DRAFT regulation to amend the CLP Regulation. If approved, it may become effective at the end of 2017.

On November 25, 2015, the WTO circulated notification document number 15-6246 [1] announcing the EU proposes to adopt a draft regulation to amend Regulation (EC) 1272/2008 on Classification, Labelling and Packaging of substances and mixtures CLP Regulation) [2]. This proposal would be the ninth adaption to technical progress (ATP-9) of the CLP Regulation. The important changes in this proposed regulation include the following:

  • Amending Annex VI to the CLP Regulation to include updated classifications for 47 substances that are already subject to harmonized classification and to include new harmonized classifications for existing substances.
  • Deleting the list of substances in Table 3.2 as the harmonized classification and labelling of these substances were based on the criteria set out in Annex VI to Directive 67/548/EEC (Dangerous Preparations Directive, DPD). The DPD was repealed by the CLP Regulation in June 2015. This deletion is proposed to take effect on June 1, 2017.
  • Deleting Tinurin 123 [3] (EC number 406-750-9 and Index number 607-331-00-5) and Direct Blue FC 57087 [4] (EC number 418-870-9 and Index number 609-066-00-0) from the CLP Regulation.

According to the notification, the draft regulation is proposed:

  • To be adopted in the second quarter of 2016
  • To enter into force 20 days after publication in the Official Journal of the EU (OJEU).
  • To be effective 18 months after date of entry into force.

Highlights of some of the new substances are summarized in Table 1.
