The US consumer product safety commission (CPSC) has reopened the comment period for clarifying component part testing and lead in textiles. The effective date has now been postponed to 13 February, 2016.

In December 2015, we informed you that the CPSC published an amendment in the Federal Register delaying the effective date for the direct final rule (DFR) [1] on two existing rules to 13 January, 2016. These two existing rules are:

  • Which textile products have been determined not to exceed the 100 ppm lead content limits (16 CFR 1500.91(d)(7)) and
  • When component part testing can be used (16 CFR 1109)

On 4 January, 2016, the CPSC published a second amendment in 81 Federal Register 2 [2] announcing the reopening of the comment period and a delay in the effective date of this DFR. This change was the result of the incorrectly stated comment period deadline for the DPR on the federal regulatory content website at regulations.gov. The comment period has now been reopened to accept comments submitted until 13 January, 2016. The effective date for this DPR is now 12 February, 2016, unless the CPSC receives a significant adverse comment.
