Regarding the Press Release of Nichia Alleging a Patent Infringement by Everlight's Australian Distributor
Shulin District, New Taipei City, Taiwan, June 4, 2014 - Regarding Nichia Corporation's ("Nichia") press release of new legal action initiated in the Australian Federal Court alleging products made by Everlight Electronics Co., Ltd. ("Everlight") and distributed by Arrow Electronic Australia ("Arrow") have infringed Australian patent 720234, Everlight strongly believes that said Australian patent is invalid and there is no patent infringement by Everlight's products. Everlight will assist its customer Arrow to vigorously defend the allegations made in the Australian Federal Court proceeding. A few days ago, the Japanese Patent Office declared the entire claims of Japanese patent 4530094 invalid, and said Japanese patent is one of Nichia's patent families corresponding to the Australian patent-in-suit.
Everlight has initiated patent invalidation proceedings in major countries world-wide to counterattack Nichia's action.
